These Terms of Service explain how Forever Guardian works, what you can expect, and our commitments to you and your pet’s memories.

At Forever Guardian, we believe the bond between people and their pets deserves to be celebrated, remembered, and preserved.
These Terms of Service (“Terms”) govern your access to and use of the Forever Guardian website, membership offerings, digital experiences, and related services provided by PetGuardian Club LLC, operating under the Forever Guardian brand (“Forever Guardian,” “we,” “us,” or “our”).

By accessing our website or agreeing to these Terms when registering or purchasing, you agree to be bound by them. If you do not agree, please do not register for or purchase our services.
Please read these Terms carefully, particularly the sections concerning prelaunch products, delivery, refunds, digital content, and service availability.

We are committed to clear terms, fair policies, and respecting your relationship with your pet.
Some features and experiences may not yet be available. We will keep you informed as we progress.
Forever Guardian is developing personalized digital experiences designed to help pet owners preserve memories of their pets and create digital representations of them.
Our vision includes personalized pet digital twins, interactive experiences, and mobile, augmented reality (AR), and virtual reality (VR) capabilities.
Forever Guardian is a developing product. Certain features, experiences, platforms, and services described on our website may not yet be available.
Descriptions of planned functionality represent development goals unless expressly identified as currently available.
We do not guarantee that every proposed feature, device integration, or experience will be included in the final product.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create a paid account or purchase a membership.
You agree to provide accurate and current registration information and maintain the confidentiality of your account credentials.
You are responsible for activity occurring through your account, except to the extent caused by our own failure to meet applicable obligations.
You may not impersonate another person, create accounts for fraudulent purposes, or use the services in violation of applicable law.
We may require verification of account ownership before granting access to personal information, restoring an archived account, or processing certain requests.
Forever Guardian offers or plans to offer prelaunch opportunities for customers to participate in the development of personalized pet digital twin experiences.
Our planned products include a mobile digital twin experience and an immersive VR experience.
Founding Members may receive opportunities to participate in development, share information about their pets, provide feedback, and receive access to available experiences as development progresses.
The currently advertised Founding Member offer is $497.97 as a one-time purchase, subject to the specific benefits and terms presented at checkout.
Forever Guardian does not guarantee a specific launch date for the mobile application, VR experience, or delivery of an individual digital twin.
Development timelines may change because of technical requirements, testing, platform approvals, or other factors.
We are committed to providing Founding Members with progress updates regarding development milestones, anticipated availability, and material changes affecting their purchases.
Founding Membership is intended to provide lifetime access to the purchased digital twin experience, subject to continued service availability, technical compatibility, applicable membership terms, and circumstances beyond our reasonable control.
Lifetime access does not guarantee that every feature, device, platform, or supporting service will remain available indefinitely.
Any future paid upgrades or optional services will be disclosed separately and will not automatically result in additional charges.
Forever Guardian is developing personalized mobile and VR digital twin experiences.
The mobile application and VR experiences may become available at different times.
A customer's digital twin may require photographs, videos, audio recordings, descriptions, and other materials before creation can begin.
The quality and characteristics of the resulting experience may depend on the materials provided, available technology, and the stage of development.
Digital twins are computer-generated interpretations, not exact reproductions of living animals.
We do not guarantee that a digital twin will perfectly reproduce your pet's appearance, movements, sounds, personality, or behavior.
Interactive responses may be simulated or generated using artificial intelligence and should not be interpreted as evidence of consciousness, actual animal communication, or the continued existence of a deceased pet.
For purposes of these Terms, a digital twin is considered completed and delivered when the relevant personalized experience has been generated, is available for its intended use, and the customer has been provided access to it.
Internal generation, development testing, or completion of a file that has not been made available to the customer does not, by itself, constitute delivery.
Completion and delivery of the mobile experience do not automatically constitute completion and delivery of the VR experience, or vice versa.
We will communicate material changes affecting purchased offerings and provide remedies required by applicable law.
To create a personalized digital representation of your pet, Forever Guardian may request photographs, videos, audio recordings, descriptions, stories, and other information.
You agree to provide materials you are authorized to submit.
The quality and characteristics of the resulting digital twin may depend on the materials provided, available technology, and the stage of development.
You understand that the experience is intended for personal remembrance, connection, and enjoyment.
Forever Guardian may provide reasonable instructions concerning image quality, file formats, or other requirements necessary to create a personalized experience.
Your pet's memories belong to you.
You retain your ownership rights in original photographs, videos, audio recordings, written stories, and other content you submit, subject to any third-party rights.
By submitting content, you grant Forever Guardian and authorized service providers a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, and use that content solely as reasonably necessary to provide, maintain, secure, and support the services you request, including creation of your personalized digital twin.
This license does not authorize public advertising use or general AI model training without the separate permissions described in our Privacy Policy.
You represent that you own the submitted content or have the necessary rights and permissions to provide it for these purposes.
Forever Guardian retains its rights in its underlying software, technology, models, designs, trademarks, and proprietary systems.
Your rights to access or use a generated digital twin are governed by the membership or purchase terms applicable to that experience. Unless expressly stated otherwise, purchasing a membership does not transfer ownership of Forever Guardian's underlying technology or intellectual property.
Your permission to create a personalized digital twin is not permission to train general AI models using your personal content.
Forever Guardian will not use customer-submitted pet photographs, videos, audio recordings, stories, or other personal content for general AI model training or improvement without separate, explicit, affirmative permission.
We will not authorize third-party providers acting on our behalf to use such content for general AI training without that permission.
Likewise, Forever Guardian will not publicly display customer pet content or digital twins in advertisements, social media, testimonials, or promotional materials without express permission.
Any optional AI-training or public-marketing permissions will be requested separately, will not be preselected, and will not be required to purchase the core service.
You may withdraw optional permissions by contacting [email protected], subject to applicable law and limitations concerning prior processing or materials already distributed.

Forever Guardian may offer separate mobile digital twin products, VR experiences, and bundled Founding Membership packages.
Current planned offerings include:
Mobile Digital Twin: $67 introductory purchase price.
Founding Membership: $497.97 one-time purchase price, with included benefits described in the applicable offer.
The price and included features of any separately purchased VR experience will be disclosed before payment.
All applicable charges, taxes, and purchase terms will be presented at checkout.
A one-time purchase does not authorize recurring billing.
Future subscriptions, optional upgrades, or additional services will require separate disclosure and any authorization required by law.
Payments may be processed by authorized third-party providers, including Stripe.
You agree to provide valid payment information and authorize the charges clearly presented and accepted at checkout.
We may change prices for future purchases. Such changes will not retroactively alter a completed purchase unless expressly agreed or legally permitted.
Forever Guardian recognizes that customers purchasing prelaunch products are placing their trust in technology that is still being developed.
We want our refund policy to be fair, understandable, and respectful of that commitment.
Customers who purchase the $67 mobile digital twin product may request a full $67 refund at any time before their personalized mobile digital twin has been completed and delivered.
A customer does not need to wait for the official mobile application launch to request an eligible prelaunch refund.
Once the customer's personalized mobile digital twin has been completed and made available to them, the purchase becomes nonrefundable under our voluntary refund policy, except where applicable law requires otherwise.
Customers who purchase a VR digital twin experience separately may request a refund of the applicable VR purchase price at any time before receiving their completed personalized VR digital twin.
Once the completed VR digital twin has been delivered or made available to the customer, the purchase becomes nonrefundable under our voluntary refund policy, except where applicable law requires otherwise.
Founding Members who purchase the $497.97 package may request a full $497.97 refund at any time before either their personalized mobile digital twin or their personalized VR digital twin has been completed and delivered.
This refund is available even if the official mobile application or VR experience has not yet launched.
Customers do not need to provide a reason for requesting an eligible pre-delivery refund.
If a Founding Member has received one completed digital twin experience but has not received the other, the completed and delivered component is generally nonrefundable under our voluntary refund policy, except where applicable law requires otherwise.
The customer may remain eligible for a refund attributable to the undelivered component.
The allocation of the $497.97 package price between the mobile and VR components, and the resulting partial-refund amount, must be clearly disclosed in the applicable purchase terms before payment.
If that allocation has not been established, Forever Guardian will not impose an undisclosed allocation to reduce a customer's refund. Any such request will be resolved consistently with the customer's purchase terms and applicable law.
Once both purchased digital twin experiences have been completed and delivered, no voluntary refund is available under this policy, except where applicable law requires otherwise.

Please include the email address associated with your purchase and identify the product for which you are requesting a refund.
We may request reasonable information to verify the purchase and prevent unauthorized refunds.
Approved refunds will generally be issued to the original payment method, subject to payment processor requirements and applicable law.
Forever Guardian does not guarantee a specific product launch date.
We will provide development progress updates and communicate material changes affecting purchased offerings.
If a purchased product cannot be delivered, is materially different from what was represented, or is subject to other legally recognized cancellation or refund rights, we will provide the remedies required by applicable law.
Nothing in this refund policy limits statutory cancellation rights, remedies for nondelivery, or other consumer protections that cannot legally be waived.
The voluntary no-refund provisions apply only after the relevant digital twin has been completed and delivered or made available, and only to the extent permitted by law.
Forever Guardian intends to preserve members' pet memories even after they cancel their membership.
When an account is canceled, we intend to archive associated pet profiles, photographs, videos, audio recordings, stories, memories, and digital twin materials rather than automatically deleting them.
Archived accounts have no fixed expiration period.
Our intention is to allow returning members to restore their accounts and reconnect with their preserved content.
However, we cannot guarantee permanent storage, uninterrupted availability, or compatibility with future versions of our technology.
Restoration may require identity verification and may depend on service availability and technical compatibility.
Account cancellation does not itself authorize continued recurring membership charges.
You may request deletion of eligible personal information instead of archiving, subject to applicable legal exceptions.

We may investigate suspected violations and take proportionate action, including restricting or suspending access where reasonably necessary.

The Privacy Policy describes our collection and processing of information, use of analytics and advertising technologies, optional consent choices, account archiving, and available privacy rights.
Forever Guardian plans to use Meta Pixel and Google Analytics to measure website performance and advertising effectiveness, subject to applicable privacy requirements and controls.
We will not intentionally include customer-uploaded pet photographs, videos, personal stories, or digital twin content in advertising tracking events.
Privacy and deletion requests are initially handled through [email protected].
Self-service privacy controls are planned for a future Member Portal and should not be understood as currently available.
The Forever Guardian name, logos, website design, software, user interfaces, digital twin systems, and other proprietary materials are owned by or licensed to PetGuardian Club LLC.
These Terms grant you a limited, nonexclusive, nontransferable right to access and use available services for lawful personal purposes, subject to the applicable purchase terms.
You may not reproduce, distribute, commercially exploit, or create unauthorized derivative works of our proprietary materials without permission, except as allowed by law.
These restrictions do not transfer ownership of your original pet photographs, videos, or personal stories to Forever Guardian.
Forever Guardian may rely on third-party services for payment processing, hosting, storage, communications, artificial intelligence, analytics, and other technical functions.
Certain experiences may also depend on third-party devices, applications, or platforms.
Those services may have their own terms, privacy policies, technical requirements, and availability limitations.
We are not responsible for independent third-party services outside our control, except to the extent required by law or applicable contractual obligations.
We will seek appropriate safeguards for providers processing customer content on our behalf.
We aim to provide reliable services but cannot guarantee uninterrupted or error-free availability.
Our website or digital experiences may be temporarily unavailable because of maintenance, security updates, technical failures, third-party outages, or other circumstances.
We may update, modify, or discontinue features as our technology develops.
Where changes materially affect purchased benefits, we will address them in accordance with the applicable purchase terms and consumer protection laws.
We will not rely on this section to eliminate legally required remedies for nonperformance or misrepresentation.
To the extent permitted by applicable law, Forever Guardian's services are provided on an “as available” basis.
We do not guarantee that digital representations will perfectly reproduce a pet's appearance, personality, behavior, or characteristics.
We do not guarantee uninterrupted access, compatibility with every device, or availability of proposed features by a specific date.
To the extent permitted by law, PetGuardian Club LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the services.
Any limitation of liability will apply only to the extent enforceable under applicable law.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or restricted, or eliminates mandatory consumer rights and remedies.
We may update these Terms as our business, services, technology, or legal obligations change.
When changes are made, we will update the “Last Updated” date.
We may provide additional notice of material changes where required or appropriate.
Material changes to purchased benefits or existing contractual rights will be handled in accordance with applicable law and the terms governing the original purchase.
Where affirmative consent is legally required, we will request it.
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.
If a dispute arises, we encourage you to contact us first so we can attempt to resolve the matter informally.
Nothing in these Terms prevents either party from pursuing remedies available under applicable law.
We do not require arbitration or waive class-action rights through this provision.
